Why Erosion Control Matters in North Texas

DFW’s clay soil is uniquely vulnerable to erosion. When exposed by construction activity, the fine clay particles are easily carried off by stormwater runoff. The Blackland Prairie clay that dominates our region creates several specific challenges:

Every ton of soil that leaves your site ends up in local creeks, rivers, and lakes — including Lake Ray Hubbard, Lake Lewisville, and the Trinity River. Sediment is the #1 pollutant by volume in Texas waterways.

TCEQ Requirements: What You Need to Know

The Texas Commission on Environmental Quality regulates stormwater discharge from construction sites under the Texas Pollutant Discharge Elimination System (TPDES) .

Who needs a permit:

  • Any construction activity that disturbs **one acre or more** of land
  • Sites smaller than one acre that are part of a larger common plan of development
  • This includes clearing, grading, excavation, and stockpiling activities

Key requirements:

  • Submit a **Notice of Intent (NOI)** to TCEQ before construction begins
  • Develop and implement a **Stormwater Pollution Prevention Plan (SWPPP)**
  • Install and maintain **Best Management Practices (BMPs)** for erosion and sediment control
  • Conduct regular inspections and maintain documentation
  • Submit a **Notice of Termination (NOT)** when construction is complete and the site is stabilized

Straw Wattles and Fiber Rolls

Effective for slope interruption and channel protection:

  • Install on contours at intervals based on slope steepness (10-20 feet apart on 2:1 slopes)
  • Stake securely with wooden stakes driven through the center
  • Trench the bottom edge to prevent undercutting
  • Replace when saturated or damaged

Hydroseeding and Temporary Stabilization

The most effective long-term erosion control is vegetation. For temporary stabilization:

  • **Hydroseed** with a fast-germinating annual rye grass and native seed mix
  • **Apply hydromulch** (wood fiber with tackifier) on slopes steeper than 3:1
  • **Use rolled erosion control products (RECPs)** — jute netting, coconut fiber blankets, or synthetic turf reinforcement mats on critical slopes
  • **Stabilize within 14 days** of final grading per TCEQ requirements

Inlet Protection

Protect storm drains from sediment-laden water:

  • Use sediment filter bags, block-and-gravel barriers, or proprietary inlet filters
  • Clean or replace after each rain event
  • Never block inlets completely — allow overflow during extreme events

Inspection Schedule and Documentation

TCEQ requires inspections at specific intervals:

  • **At least once every 7 days**
  • **Within 24 hours after a rainfall event of 0.5 inches or more**
  • **More frequently during active construction phases**

What to document:

  • Date, time, and weather conditions
  • Name and signature of inspector
  • BMP condition (functional, needs repair, failed)
  • Corrective actions taken
  • Photographs of all BMPs and any problem areas

Record retention: Keep all inspection reports, SWPPP documents, and correspondence for at least 3 years after project completion.

Common Violations and How to Avoid Them

TCEQ enforcement actions in the DFW region frequently cite these violations:

  1. **No SWPPP on site** — The plan must be physically available at the construction site
  2. **Inadequate perimeter controls** — Silt fences not installed before grading begins
  3. **Sediment tracking onto public roads** — No stabilized construction entrance
  4. **Inlet protection missing or failed** — Sediment entering storm drains
  5. **Incomplete inspection reports** — Missing signatures, dates, or corrective actions
  6. **Failure to stabilize** — Exposed soil left unstabilized for more than 14 days

Fines: TCEQ can assess penalties of up to $25,000 per day per violation. In 2023, several DFW construction sites received fines ranging from $5,000 to $50,000 for erosion control violations.

DFW-Specific Challenges

Clay soil erosion: Unlike sandy soils that erode gradually, clay soil tends to form deep rills and gullies during heavy rain. Once a gully starts, it deepens rapidly. Inspect slopes after every rain and repair rills immediately.

Heavy rain events: DFW’s thunderstorms can drop 2-4 inches in an hour. Design your BMPs for the 10-year, 24-hour storm event (approximately 5-6 inches in the DFW area). Temporary controls should be oversized to handle these events.

Freeze-thaw cycles: Winter freeze-thaw cycles destabilize exposed soil. Apply temporary stabilization (straw mulch or hydromulch) before winter to protect slopes during freeze-thaw conditions.

Wind erosion: During dry periods, exposed clay soil creates dust that can drift onto neighboring properties. Use water trucks, dust suppressants, or temporary vegetation to control wind erosion.
